The submitted dossier clearly states 2 contents on the declaration form No. 11DK: Receiving the transfer of all land use rights and issuing a new red book.
Readers wonder, in the above case, will the new certificate be issued or will the information on the red book of the old owner only be corrected?
Responding to this issue, the Ministry of Agriculture and Environment said that Point a, Clause 1, Article 133 of the 2024 Land Law stipulates that land change registration is carried out when the land plot has been granted a Certificate, in which the land user exercises his rights and obligations, including the transfer of land use rights.
The order and procedures for registering changes in land use rights transfer are implemented according to the provisions of Clause 4, Article 37 of Decree No. 101/2024 of the Government regulating basic land investigation; registration and issuance of certificates of land use rights, ownership of assets attached to land and the Land Information System.
Accordingly, after carrying out the procedure for registering changes in rights, the Branch of the Land Registration Office will issue a new certificate or confirm it on the issued certificate (according to the needs of the land user) as prescribed in Point d, Clause 3, Article 37 of Decree No. 101/2024.
