Clause 1, Article 76 of the 2023 Housing Law stipulates:
1. People with revolutionary contributions and relatives of martyrs who are eligible for support to improve their housing according to the provisions of the Ordinance on Incentives for People with Revolutionary contributions.
Clause 1, Article 78 of the 2023 Housing Law stipulates:
1. Subjects specified in Clauses 1, 4, 5, 6, 7, 8, 9 and 10, Article 76 of this Law who buy or rent social housing must meet the following conditions:
a) Housing conditions: subjects specified in Clauses 1, 4, 5, 6, 7, 8, 9 and 10, Article 76 of this Law to be able to buy or rent social housing must not have a house of their own in the province or centrally run city where there is a social housing construction investment project, have not been able to buy or rent social housing, and have not enjoyed any form of housing support policies in the province or centrally run city where there is a social housing construction investment project or have a house of their own in the province or centrally run city where there is a social housing project but the average housing area per capita is lower than the minimum housing area; in case of subjects specified in Points b, c, d, e, g and g, Clause 1, 45 of this Law, they must not be in public housing. The Government stipulates in detail this point;
b) Income conditions: subjects specified in Clauses 5, 6, 7 and 8, Article 76 of this Law to be able to buy or rent social housing must meet the income conditions prescribed by the Government; subjects specified in Clause 4, Article 76 of this Law must be poor or near-poor households according to Government regulations.
At point c, clause 1, Article 3 of the Ordinance on Preferential treatment for people with revolutionary contributions, it is stipulated that "meticulous" is a person with revolutionary contributions. Accordingly, Clause 1, Article 3 of the Ordinance on Preferential treatment for people with revolutionary contributions stipulates:
2. Relatives of people with meritorious services to the revolution include biological father, biological mother, husband or wife, children (biological children, adopted children), people with meritorious services to support martyrs.
Clause 2, Article 1 of Decree No. 261/2025/ND-CP dated October 10, 2025 stipulates: "... In case the plaintiff is married according to the provisions of law, the plaintiff and his/her husband (husband) with a total average monthly income shall receive no more than 40 million VND according to the Salary and Salary Table confirmed by the agency, unit, or enterprise where the subject works".
Clause 2, Article 1 of Circular No. 32/2025/TT-BXD dated November 10, 2025 of the Minister of Construction stipulates: In case the person applying for the purchase or hire-purchase of a married social housing, the wife or husband of that person must also declare a form of documents proving the income conditions according to Form No. 01a or Form No. 04 or Form No. 05 in Appendix I issued with Circular 05/2024/TT-BXD.
Based on the above regulations, relatives of martyrs must meet housing conditions, not income conditions, to buy or rent social housing.
In case the martyrs' relatives are married, the husband or wife of the martyrs' relatives must still confirm their income conditions according to the provisions of law.
