According to Clause 2, Article 9 of Circular 05/2022/TT-BTP, salary classification is regulated as follows:
The salary classification into the professional title of civil servants as prescribed in Clause 1 of this Article for civil servants whose salaries have been classified into ranks as prescribed in Circular No. 06/2010/TT-BNV dated July 26, 2010 of the Minister of Home Affairs stipulating the titles and codes of legal aid civil servant ranks, Decree No. 204/2004/ND-CP and Decree No. 17/2013/ND-CP are implemented:
In case the civil servant is eligible for appointment to a professional title with a salary scale coefficient equal to the old salary scale, the salary scale and the percentage (percent) of seniority allowance exceeding the framework (if any) currently enjoyed in the old salary scale will be arranged equally (including the time for considering the next salary increase or considering seniority allowance exceeding the framework if in the old scale) to the newly appointed professional title.
After changing the professional title, civil servants who have been appointed by competent authorities to the professional title according to the provisions of this Circular are arranged in salary according to the instructions in Clause 1, Section II of Circular No. 02/2007/TT-BNV dated May 25, 2007 of the Minister of Home Affairs guiding salary arrangement when upgrading, transferring ranks, and changing types of civil servants and public employees.
Thus, for legal aid officers eligible for appointment to a professional title with a salary scale coefficient equal to the old salary scale and the seniority allowance percentage exceeding the framework (if any) currently held at the old salary scale (including calculating the time for considering the next salary increase or considering seniority allowance exceeding the framework if held at the old salary scale) to the newly appointed professional title.
