Youme Law Firm LLC said that according to Section 2 of Instruction 01/HD-UBND in 2025, the principles of assessment for cadres, civil servants, public employees and workers to implement the restructuring of the apparatus, streamlining the payroll and restructuring, improving the quality of cadres and civil servants and resolving policies and regimes are as follows:
- Comply with the provisions of Decree 178/2024/ND-CP, Decree 67/2025/ND-CP and Instruction 01/HD-UBND in 2025.
- Link the assessment with streamlining the payroll, restructuring, improving the quality of the team of cadres, civil servants, and public employees of each agency, organization, and unit in the process of restructuring the apparatus...
- On the basis of the number of people who have voluntarily resigned from competent authorities to agree, from the evaluation results, agencies, organizations and units continue to determine the number of people who need to consider streamlining to meet the criteria of 25% reduction in the number of cadres, civil servants, officials and employees in accordance with the central regulations, ensuring the principle of streamlining those who have the lowest assessment results from the bottom up.
- In addition to the target of reducing 25% of cadres, civil servants, and public employees, agencies, organizations, and units can base on the results of the assessment to continue screening to improve the quality of the team to meet the requirements of assigned tasks.
- For cadres, civil servants and public employees who have not met the training standards after the organizational arrangement; professional degrees that do not match the job position requirements approved by competent authorities, agencies, organizations and units shall consider and evaluate to resolve policies according to regulations.
According to Clause 1.1, Section 4 of Instruction 01/HD-UBND in 2025, based on the number of people who voluntarily applied for early retirement or quit their jobs, agencies, organizations and units will consider evaluating and specifically resolving each case in the following priority order:
- Cadres, civil servants, public employees, and workers who are in poor health and do not meet job requirements;
- For civil servants, public employees, and workers after the restructuring of the apparatus and the restructuring of administrative units who do not meet the training standards; professional degrees that do not meet the job position requirements approved by competent authorities;
- Cadres, civil servants, public employees, and workers with less than 10 years of service until the retirement age according to regulations.
- Other criteria (encouraging specialized agencies, organizations, and units):
+ Officials, civil servants and employees who wish to quit their jobs or retire early to change careers and stabilize family life.
+ Other criteria are developed by the agency, organization, or unit itself, ensuring that they are suitable to the characteristics of the situation and the reality of the agency, organization, or unit.
