Article 23 of the Law on Organization of Local Government (effective from June 16, 2025) stipulates the duties and powers of the Chairman of the People's Committee of the commune.
Accordingly, the Chairman of the People's Committee of the commune has 17 tasks and powers. In particular, the Chairman of the People's Committee of the commune has the task and right to direct and organize the implementation of the work of recruiting, using and managing civil servants and public employees in the area according to the provisions of law and the decentralization of higher-level state agencies; decide to appoint, dismiss, transfer, and remove from the position of head or deputy head of another professional agency, administrative organization, or public service unit under the People's Committee at his or her level; decide to temporarily suspend the work of the Vice Chairman of the People's Committee at his or her level, the head of another professional agency, administrative organization, or public service unit under the People's Committee at his or her level.
Thus, according to the provisions of the Law on Organization of Local Government, the Chairman of the Commune People's Committee has the right to decide to temporarily suspend the work of the head of a public service unit under the Commune People's Committee.
