The Government has submitted to the National Assembly the Law on Cadres and Civil Servants to replace the current Law on Cadres and Civil Servants and take effect from July 1, 2025.
Pursuant to the Law on Cadres and Civil Servants 2025, the Government issued Decree No. 170/2025 on recruitment, use and management of civil servants. The Decree clearly states the regulation on abolishing related contents on commune-level civil servants in Decree No. 33/2023/ND-CP of the Government (regulations on commune-level cadres, civil servants and part-time workers at the commune level, in villages and residential groups).
The Law on Cadres and Civil Servants has connected commune-level cadres and civil servants with provincial levels, unifying a civil service regime from the central to commune levels to implement the policy of building a unified, interconnected, and synchronous civil service from the central to commune levels, without distinguishing between commune-level cadres and civil servants and provincial levels.
Regulates the transition of commune-level cadres and civil servants according to regulations to cadres and civil servants according to new regulations of the Law on Cadres and Civil Servants if they meet the standards and conditions on training qualifications without the requirements on working time, standards and conditions of civil servant ranks.
Resolution No. 76/2025/UBTVQH15 of the National Assembly Standing Committee on the arrangement of administrative units stipulates: " Maintain current benefits, salary policies and position allowances (if any) of cadres, civil servants and public employees affected by the arrangement of administrative units who are still cadres, civil servants and public employees at agencies and organizations in the political system for 6 months from the date of the work arrangement document. After this time, implement the regime, policies and position allowances according to the provisions of law".

According to Decree 33/2023, commune-level cadres and civil servants who have graduated with training levels according to the standards on professional qualifications and skills are allowed to be classified as administrative civil servants with the same training level as those specified in the professional and technical salary table for cadres and civil servants in state agencies issued together with the Government's Decree on salary regime for cadres, civil servants, public employees and armed forces.
The training level diploma is implemented according to the regulations of the Ministry of Education and Training and the competent authority or organization issuing the certificate.
In case during the working period, commune-level cadres and civil servants have changes in their training level in accordance with the current position and title, the Chairman of the District People's Committee shall be proposed to arrange salaries according to the new training level from the date of graduation.
In case a person elected as a commune-level cadre, recruited or accepted to work as a commune-level civil servant as prescribed in this decree but has worked for a period of compulsory social insurance payment, and has not received a one-time social insurance subsidy, the working period with compulsory social insurance payment will be counted as the basis for salary classification (except for probationary and probationary periods), the working period with non-continuous compulsory social insurance payment will be accumulated.
