In recent years, many cases of workers stopping work collectively in Nghe An have been resolved quickly and effectively thanks to the active participation of the Trade Union. Mr. Kha Van Tam - Chairman of Nghe An Provincial Federation of Labor - shared with Lao Dong Newspaper about his experience in coordinating the handling of these cases.

Nghe An has recorded a number of collective work stoppages. Can you share about the role and responsibility of the Provincial Federation of Labor in resolving these situations?

- In recent years, the number of enterprises, including FDI enterprises, has increased in Nghe An, leading to labor disputes. Therefore, a number of collective work stoppages have occurred in the province. Recent collective work stoppages in the area have been spontaneous and not in accordance with legal procedures. However, with the responsibility to care for and protect the legitimate rights and interests of workers, the Trade Union organizations in Nghe An still quickly took action, coordinating to completely resolve the case.

The union officials clearly understood the basis and concerns of the workers, so the matter was resolved quickly and satisfactorily. Union officials are a support for union members and employees. The role of finding a common voice on the basis of ensuring the harmonious interests of trade union cadres becomes the main task in these situations.

How do you evaluate the effectiveness of the measures taken by the Provincial Federation of Labor in resolving collective work stoppages in recent times?

- When a strike occurs, the Provincial Steering Committee for Prevention and Control of Strikes has coordinated and taken effective measures to resolve the situation. Relevant levels and sectors (LDLD, DDTBXH, provincial police, People's Committees of districts, cities, towns, Southeast Economic Zone Management Board...) were present to work with employers. In particular, union officials are always the first to be present at "hot spots" to find the key to resolving conflicts.

The important thing is how to help employees understand what are "legitimate and legitimate rights and interests" instead of demands and recommendations beyond the business's capacity to take the right action. At the same time, it mobilizes workers to return to work and stabilizes the production situation. Therefore, most of the illegal work stoppages and strikes in Nghe An in recent times have been basically resolved quickly.

Strengthening dialogue to build harmonious and sustainable labor relations

Can you share some practical experiences that the Provincial Federation of Labor has successfully applied in resolving collective work stoppages?

- As soon as the information is grasped, the union cadres must calmly grasp the situation of the unit and the recommendations of the employees, analyze and accurately assess the nature of the incident, thereby coordinating with the authorities to work with the enterprise, and at the same time clearly explain to the workers to find a common voice on the basis of ensuring harmonious benefits.

reality shows that any enterprise that grassroots trade unions promote their role, functions and tasks well, especially in dialogue and implementing grassroots democracy, where harmonious, stable labor relations and strikes are unlikely to occur. Therefore, the role of the grassroots union chairman is very important in preventing, limiting and resolving strikes.

Currently, regulations on the order and procedures for strikes according to the 2019 Labor Code are relatively complicated, the time to prepare for the long-term strike while the frustration of employees requires immediate resolution. Therefore, the competent authority needs to consider issuing regulations on the order of strikes in the direction of simplifying procedures and shortening preparation time.

In addition, it is necessary to strengthen dialogue between parties in labor relations, promote well these typical dialogue and negotiation models for dissemination.

On the other hand, it is necessary to strictly implement regulations on investment management. When granting investment certificates for projects, it is necessary to clearly define the responsibilities of investors in ensuring compliance with labor law regulations and commit to implementation in writing.

It is necessary to strengthen inspection and examination of the implementation of labor laws, especially for enterprises that frequently show signs of violations and are at risk of collective labor disputes to take remedial and preventive measures; resolutely handle cases of intentional violations of the Labor Law.
