Before July 1, 2025, according to Section d, Clause 2, Article 34 of the Law on Social Insurance 2014, the period of maternity leave prescribed in this Clause shall be calculated within the first 30 days from the date the wife gives birth.
However, from July 1, 2025, within 60 days from the date of the wife's birth, male employees participating in compulsory social insurance are entitled to take maternity leave for the following period:
- 5 working days when the wife gives birth naturally.
- 7 working days when the wife gives birth and requires surgery or gives birth under 32 weeks old.
- 10 working days when the wife has twins. Male workers will have 3 additional days off (ie 13 days) for each child born in the third child or more in the case of fatherhood and fatherhood.
- 14 working days when the twin wife had to undergo surgery. In case of 3 or more children who need surgery, 3 more days off for each child from the 3rd child onwards.
In case the employee takes a break many times, the start date of the last break must be within the first 60 days from the date the wife gives birth and the total leave period to enjoy maternity benefits must not exceed the prescribed time.
Thus, from July 1, 2025, male workers will be given a day off for taking care of their wives and children for the first 60 days from the date of the wife's birth instead of only having a day off for the first 30 days as before. The total leave period does not exceed the time prescribed in Clause 2, Article 53 of the Law on Social Insurance 2024.
