Clause 6, Article 70 of the Law on Social Insurance 2024 (effective from July 1, 2024) stipulates:
In case the employees specified in Points b, c and d Clause 1 and Points b, c and d Clause 2 of this Article are both eligible for pension and one-time social insurance, they can choose to receive monthly pension or one-time social insurance.
According to the provisions of the law, the following cases that are both eligible for pension and one-time social insurance will be able to choose to receive monthly pension or one-time social insurance:
- Workers are Vietnamese citizens going abroad to settle;
- The employee is a Vietnamese citizen suffering from one of the following diseases: cancer, paralysis, decompensated cirrhosis, severe tuberculosis, AIDS;
- Workers who are Vietnamese citizens with a working capacity reduction of 81% or more; people with especially severe disabilities;
- Foreign workers suffering from one of the following diseases: cancer, paralysis, decompensated cirrhosis, severe tuberculosis, AIDS;
- Foreign workers with a reduced working capacity of 81% or more; people with extremely severe disabilities;
- Foreign employees whose labor contracts terminate or whose work permits, practice certificates, or practice licenses expire without being renewed.
