Youme Law Firm LLC said that according to Article 90 of the 2019 Labor Code, wages are the amount of money that employers pay employees according to the agreement to perform work, including salary according to job or position, salary allowances and other supplements.
The salary according to work or position must not be lower than the minimum wage.
According to Article 91 of the 2019 Labor Code, it is stipulated that:
Minimum salary
1. The minimum wage is the lowest wage paid to employees doing the simplest work in normal working conditions to ensure the minimum living standard of employees and their families, in accordance with socio-economic development conditions.
2. The minimum wage is established by region, fixed by month and hour.
3. The minimum wage is adjusted based on the minimum living standard of employees and their families; the correlation between the minimum wage and the market salary; the consumer price index, economic growth rate; the relationship between labor supply and demand; employment and unemployment; labor productivity; and the ability to pay of enterprises.
4. The Government shall detail this Article; decide and announce the minimum wage based on the recommendations of the National Wage Council.
Accordingly, the minimum wage is the lowest wage paid to employees doing the simplest work in normal working conditions to ensure the minimum living standard of employees and their families, in accordance with socio-economic development conditions.
Thus, the current salary of garment workers according to the agreement between the employer and the employee is not lower than the regional minimum wage.
The current regional minimum wage is stipulated in Article 3 of Decree 74/2024/ND-CP applied from July 1, 2024 as follows:
- Region 1 is 4,960,000 VND/month; 23,800 VND/hour.
- Region 2 is 4,410,000 VND/month; 21,200 VND/hour.
- Region 3 is 3,860,000 VND/month; 18,600 VND/hour.
- Region 4 is 3,450,000 VND/month; 16,600 VND/hour.
