Lawyer Chau Duy Nguyen - An Dang Law Office (under the Ho Chi Minh City Bar Association) - said that from July 1, 2025, the 2024 Social Insurance Law will officially take effect, marking an important change in social security policies in Vietnam.
According to the provisions of the Social Insurance Law 2024, the compulsory social insurance contribution level will be restructured in a clearer and more detailed manner, in order to expand coverage and increase sustainability for social security funds. The total compulsory social insurance contribution rate includes: 3% of the salary used as the basis for contributions to the Sickness and Maternity Fund, and 22,2% of the salary used as the basis for contributions to the Pension and Death Fund.
Of which, employers are responsible for contributing 14% to the Pension and Death Fund, 3% to the sickness and Maternity Fund. Employees will contribute 8% to the Pension and Death Fund.
Lawyer Nguyen added: In addition to the above contributions, employers must also participate in a number of other insurance funds for employees, including: 0.5% of salary in the Occupational Accident and Disease Insurance Fund, 1% of salary in the Unemployment Insurance Fund and 3% of salary in the Health Insurance Fund. Meanwhile, employees are responsible for paying 1.5% of their salary to the Health Insurance Fund and 1% of their salary to the Unemployment Insurance Fund.
In total, employers pay 21.5% of each employee's salary, while employees pay 10.5%."
Lawyer Chau Duy Nguyen also emphasized: With the above compulsory social insurance contribution rate, employees need to clearly understand the purposes for which their monthly salary deductions are used. mastering the receiving payment mechanism is the best way for workers to protect their own rights, avoid being evaded, owed or incorrectly declared by businesses.
Lawyer Nguyen - also advised: "In the past, many businesses, although they have deducted money from employees' salaries, have not paid to social insurance agencies, leading to employees not being able to settle benefits such as maternity, sickness or retirement. To ensure their legitimate and legal rights, employees need to regularly look up and check information about the social insurance payment status of the enterprise on the Public Service Portal or the VssID application.
