From July 1, 2025, workers without labor contracts will have the right to join trade unions according to the Trade Union Law 2024.

Pursuant to Article 7 of the Trade Union Law 2024, trade unions are allowed to represent employees without having formal labor relations. This is a group of individuals working independently, those providing order-based services, seasonal workers, or those working through digital platforms.

In addition to the right to participate, these individuals, when becoming union members, will enjoy the rights under Article 21, including: receive legal support when encountering disputes, be guided to exercise their rights and obligations according to the law, participate in collective activities organized by the union and enjoy appropriate forms of support according to the union charter.

According to the law, organizing trade unions for this group of workers can be carried out regardless of the fixed workplace or specific enterprise. This allows the formation of union models according to residential areas, occupations or specific work groups.

To participate, workers do not need to have a labor contract but only need to meet the conditions on working age and have a need to participate in the organization. The union fee payment level, forms of activities and voting rights will follow specific instructions from the Vietnam General Confederation of Labor.

The 2024 Trade Union Law consists of 6 chapters and 41 articles, passed at the 6th Session of the 15th National Assembly. The law replaces the 2012 Trade Union Law, officially taking effect from July 1, 2025.
