According to the Law on Social Insurance (SI) 2024, the rights of husbands in cases where the wife is a female employee and is pregnant and has given birth have been specifically regulated.
Pursuant to Clause 4, Article 54 of this Law, when a female employee is pregnant and gives birth, the husband participating in compulsory social insurance is entitled to take a leave of absence and enjoy maternity benefits as prescribed in Clauses 2 and 3, Article 53.
The husband's leave period is determined depending on the wife's childbirth:
- 5 working days off when the wife gives birth naturally;
- 7 working days off if the wife gives birth and has to undergo surgery or gives birth under 32 weeks old;
- 10 working days off if the wife has twins; in case of giving birth to three or more children, 3 more working days off for each child from the third child onwards;
- If the twin wife has to undergo surgery, the husband is given 14 working days off, and similarly, if he has three or more children who need surgery, he is given an additional 03 days off for each child from the third child onwards.
This new regulation affirms the legal concern for the health and psychology of families with surrogate mothers, while ensuring that husbands have time to support and care for mothers and newborns during the especially important postpartum period.
