The draft amended Decree 12/2022 (draft) amended and supplemented Clause 1, Article 36 of Decree No. 12/2022 as follows:
“1. A fine of between VND 15,000,000 and VND 30,000,000 for employers with discrimination behavior for employees, members of the Board of Directors of the Labor Representative Organization at the grassroots level, public officials Delegation for reasons for establishment, joining or organizing the representative of employees, including one of the following acts:
a) Distinguishing wages, bonuses, welfare, working hours, other rights and obligations in labor relations;
b) Requesting to participate, not participate or leave the employee representative organization at the establishment and trade union of Vietnam to be recruited, concluded or extended the labor contract, working contract;
c) Layers, labor discipline, unilateral termination of labor contracts, working contracts, not continuing to deliver labor contracts, working contracts, not renewing labor contracts, work contracts work or transfer employees to do other jobs;
d) Incident, causing difficulties related to work in order to weaken the activities of the employee representative organization at the facility ...
The draft also stipulates the level of sanctioning of misrepresenting information about trade unions. Specifically, amend and supplement Clause 3, Article 53 of Decree No. 12/2022/ND-CP as follows:
“3. A fine of between VND 20,000,000 and VND 40,000,000 shall be imposed for one of the following acts: Taking advantage of the establishment, joining or the operation of the Labor Representative Organization at the grassroots to violate the law, infringing upon the interests of the State, legitimate rights and interests of agencies, organizations, businesses and individuals; receive aid, funding and receiving technical support in contravention of law; The information is not true, agitated, distorted and defamed about the organization and union activities ”.
