Recently, the Ministry of Education and Training has received many questions from teachers related to salary and seniority allowances. In which, there is a question from Ms. Do Thuy Trang related to the pursuit of seniority allowances for teachers.
Ms. Trang said that she participated in teaching a contract with compulsory social insurance payment from September 2018 to January 2020 at high school.

In February 2020, Ms. Trang passed the civil service exam at the secondary school and worked there until March 2023. In April 2023, Ms. Trang applied to transfer to another secondary school (all benefits are enjoyed consecutively).
Ms. Trang is entitled to seniority allowances from February 1, 2025. Recently, she learned that she was entitled to seniority allowances earlier, from September 2023. Due to not knowing, Ms. Trang has not completed the documents to receive the salary and seniority allowances of the school in the past 2 years.
Ms. Trang asked, can you have additional documents and be eligible for seniority allowances according to regulations? What do you need to complete to receive this allowance?
The Ministry of Education and Training responds to this issue as follows:
The seniority allowance regime for teachers is implemented according to the provisions of Decree No. 77/2021/ND-CP dated August 1, 2021 of the Government. Accordingly, the time for calculating seniority allowances for teachers includes teaching and education time with compulsory social insurance contributions in public educational institutions (or non-public institutions if employees are subject to compulsory social insurance according to the provisions of the law on labor and education).
Specifically, teachers with teaching and education periods and who have paid compulsory social insurance for 5 years (60 months) will be entitled to seniority allowances equal to 5% of their current salary, plus leadership position allowances and seniority allowances exceeding the framework (if any). From the 6th year onwards, each year will be charged an additional 1%.
Ms. Do Thuy Trang was recruited as a civil servant in the education sector in February 2020, previously had a contract teaching period at the high school from September 2018 to January 2020 and had paid compulsory social insurance. Based on current regulations, teaching time from September 2018 will be accumulated to consider seniority allowances.
When appointed to the professional title of teacher, she will be considered for seniority allowance if she has been teaching continuously for 5 years (or accumulated), excluding probationary period.
Because it has not been considered at the right time, Ms. Trang can completely complete the procedures to request the collection of seniority allowances for teachers according to regulations.
