Mr. Do Huynh Phy Luan (Dong Thap) holds a master's degree in Political Education Methods, and was admitted to teach Civic Education at a high school from September 2007 to May 2012.
After that, Mr. Luan applied to transfer to work as a teacher teaching Politics at a secondary school from June 2012 to May 2023, salary level 5, coefficient 3.66, professional seniority 14%. In June 2023, Mr. Luan resigned and continued to participate in voluntary social insurance. In January 2025, he was recruited as a teacher teaching Civic Education at a high school.
Mr. Luan asked, are you ranked in salary grade 2, coefficient 2.67, enjoying 100% salary (not internship) and not enjoying professional seniority, or will you be preserved with accumulated working time to rank salary according to Circular No. 05/2024/TT-BNV and still be preserved with professional seniority coefficient? If you are preserved with accumulated working time, what is your salary and seniority coefficient?

Regarding this issue, the Ministry of Education and Training answers as follows:
Salary ranking for cases where they have worked in accordance with the law before recruitment and reception and have paid compulsory social insurance is carried out according to the provisions of Article 4 of Circular No. 05/2024/TT-BNV dated June 27, 2024 of the Minister of Home Affairs stipulating standards and conditions for considering promotion to rank II and rank I for administrative civil servants, clerical civil servants, and archival civil servants; salary ranking for people recruited and received into civil servants.
The salary ranking for Mr. Do Huynh Phy Luan's case is implemented according to point a, clause 3, Article 4 of Circular No. 05/2024/TT-BNV as follows:
Based on the total salary enjoyment period with compulsory social insurance contributions (if there is a non-continuous period but has not yet enjoyed the one-time social insurance regime, it is accumulated) minus the probation period calculated according to the regulations of the professional title appointed when recruiting and receiving, the remaining time is used as a basis for salary ranking in the professional title recruited and received as follows: Calculated from the grade 1 of the professional title civil servant appointed when recruiting and receiving, after each period of 03 years (36 months) for cases appointed to civil servant positions ranked as grade A0, grade A1 or after each period of 02 years (24 months) for cases appointed to civil servant positions ranked as grade B ranked up to 1 salary grade.
After converting the time to be ranked in the salary grade in the professional title appointed when recruiting and receiving mentioned above, if there are months that are not enough 36 months (for civil servants ranked as salary grade A0, grade A1) or not enough 24 months (for civil servants ranked as salary grade B), then these months are counted as the time to consider increasing salary grade for the next time or considering enjoying seniority allowances exceeding the framework (if any) in the title appointed when recruiting and receiving".
In addition, according to the provisions of point a, clause 1, Article 3 of Decree No. 77/2021/ND-CP, the time eligible for seniority allowance for teachers includes "The time of teaching and educating with compulsory social insurance contributions in public educational institutions".
Thus, the entire teaching time with compulsory social insurance contributions of Mr. Luan is included in the period of enjoying the seniority allowance for teachers.
The Ministry of Education and Training also requested Mr. Luan to provide documents proving that his work process had previously paid social insurance to be guided by competent authorities on salary arrangement and enjoying seniority allowances for teachers.
