The Department of Agriculture and Environment of Lao Cai province has just issued a decision to administratively sanction Dai Phat Mineral Joint Stock Company (Dai Phat Company) for violations in the field of water resources and minerals.
Dai Phat Company is headquartered in Khe Phao village, Chau Que commune. The legal representative is Mr. Dam Ngoc Cuong.
According to the decision, the enterprise submitted documents to calculate the fee for granting water resource exploitation rights on time.
Specifically, the surface water exploitation and use license No. 2122 issued by Lao Cai Provincial People's Committee has expired since November 10, 2024, but it was not until August 27, 2025 that Dai Phat Company prepared a dossier to calculate the fee for granting water resource exploitation rights according to regulations.
The above behavior violates Point c, Clause 3, Article 29 of Decree 36/2020/ND-CP of the Government on administrative sanctions in the field of water resources and minerals.
Dai Phat Company was subject to a monetary fine, with a total fine of VND35 million.
The company is responsible for paying the fine at the commercial bank where the State Treasury of Region IX opened the account.
In case of overdue without voluntary compliance, Dai Phat Company will be subject to enforcement according to regulations; at the same time, for each late payment day, it must pay an additional 0.05% of the unpaid fine.
