On the afternoon of June 6, at the 46th session, the National Assembly Standing Committee gave opinions on the reception, explanation, and revision of the draft Law on Management and Investment of State Capital in Enterprises.
Regarding the subjects of application (Article 2 of the draft law), there are opinions suggesting adding enterprises with investment capital from political organizations, the Vietnam Fatherland Front, and socio-political organizations to the subjects of application of the law.
Regarding this issue, the Standing Committee of the Economic and Financial Committee found that the charter capital of enterprises belonging to political organizations, the Vietnam Fatherland Front and socio-political organizations, socio-professional organizations assigned by the State when established not only includes state capital but also uses many other capital sources.
Therefore, including this group of enterprises in the scope of regulation of the draft law will not ensure consistency with the goals and subjects of regulation of the law.
However, in order to create a legal basis for investment and capital management activities of the above organizations at enterprises, Article 56 of the draft law stipulates that political organizations, the Vietnam Fatherland Front and socio-political organizations are allowed to apply the provisions of this law to manage and invest capital at enterprises.
At the same time, the Government is assigned to specify in detail the management of state capital in enterprises belonging to these organizations.
Chairman of the National Assembly's Law and Justice Committee Hoang Thanh Tung proposed to consider not including enterprises with investment capital from political organizations, the Vietnam Fatherland Front, and socio-political organizations in the subjects of the law.
However, Mr. Hoang Thanh Tung suggested clarifying the Government's detailed regulations on state capital management or regulations on the application of legal provisions to implement the management and investment of capital in the above-mentioned enterprise.
According to Deputy Minister of Finance Cao Anh Tuan, political organizations, the Vietnam Fatherland Front and socio-political organizations are subject to the provisions of this law.
"In this amendment, we have provided guidance on State capital management. As for enterprises belonging to these organizations, they are allowed to operate according to this regulation. The Government stipulates guidelines for this content if it finds it necessary, said the Deputy Minister of Finance.
