Minister of Home Affairs Pham Thi Thanh Tra has just reported on supplementing and completing the plan to arrange and streamline the Government's organizational apparatus.
The notable content in the report is the termination of the State Capital Management Committee at enterprises; transferring 18 corporations and general companies currently under the management of the State Capital Management Committee to the Ministry of Finance. Transferring Mobifone Telecommunications Corporation to the Ministry of Public Security, and the Party organization of the Corporation to be directly under the Central Public Security Party Committee.
According to the proposal of the Ministry of Public Security, the Ministry of Home Affairs reported to the Government Steering Committee to transfer 3 groups of functions and tasks to the Ministry of Public Security for management without increasing the number of units of the Ministry of Public Security.
These tasks include: State management functions and tasks on drug addiction treatment and post-treatment management and prevention and control of social evils (currently assigned to the Ministry of Labor, War Invalids and Social Affairs); State management tasks on criminal records and implementation of public services to issue criminal records (currently assigned to the Ministry of Justice); tasks on testing and issuing road motor vehicle driving licenses (currently assigned to the Ministry of Transport).
Regarding the transfer of the task of managing, testing, and granting road motor vehicle driving licenses to the Ministry of Public Security, in a recent document sent to a number of units of the Ministry of Transport (MOT), the Vietnam Road Administration said that on January 2, 2025, the Party Committee of the Ministry of Transport issued a notice on the Resolution of the Party Committee participating in giving comments on the draft Decree of the Government stipulating the functions, tasks, powers and organizational structure of the Ministry of Public Security; in which the Vietnam Road Administration was assigned to preside over and coordinate with the Department of Transport and the Department of Legal Affairs to study the content of testing and granting driving licenses, report to the Party Committee for consideration, and provide official written comments to the Ministry of Justice and the Ministry of Public Security.
After a period of research, the Vietnam Road Administration plans to report to the Party Committee of the Ministry of Transport the following contents: Proposing the Ministry of Transport to agree to transfer the tasks of training, testing, and granting driving licenses to the Ministry of Public Security; Proposing the Ministry of Transport to request the Ministry of Justice to preside over the revision of relevant legal documents and compile them into the dossier for drafting a "Resolution on handling issues arising from the arrangement of the organizational apparatus", submitting it to the competent authority for approval to ensure the smooth transfer of tasks from the Ministry of Transport to the Ministry of Public Security.
According to Lao Dong's research, in order to transfer the task of managing, testing, and granting road motor vehicle driving licenses from the Ministry of Transport to the Ministry of Public Security, the Ministry of Justice is proposed to preside over the amendment of relevant legal documents, including: Clause 9, Article 57, Clause 8, Article 60, Clause 7, Article 61, Clause 6, Article 62, Clause 4, Article 63 and Clause 3, Article 87 of the Law on Road Traffic Order and Safety; Point b, Clause 3, Article 10, Point a, Clause 2, Article 12 of Decree No. 151/2024/ND-CP.
In particular, Decree No. 151/2024/ND-CP was just signed and issued by the Government on November 15, 2024, detailing a number of articles and measures to implement the Law on Road Traffic Order and Safety.
