To promptly institutionalize the Party's policies and guidelines, the Government issued Decree No. 172/2025/ND-CP replacing Decree No. 112/2020/ND-CP of the Government on disciplinary action against cadres, civil servants and public employees and Decree No. 71/2023/ND-CP of the Government amending and supplementing a number of articles of Decree No. 112/2020/ND-CP.
This Decree takes effect from July 1, 2025.
To unify with the Law on Cadres and Civil Servants in 2025, Decree No. 172/2025/ND-CP also amends and supplements the disciplinary period.
The disciplinary period for cadres and civil servants is the period of time from the detection of violations by cadres and civil servants until a decision on disciplinary action is taken by the competent authority.
The disciplinary period is not more than 90 days; in case the case has complicated details that require time for inspection and examination to verify and clarify, the disciplinary period can be extended but not more than 150 days.
The competent disciplinary authority must ensure disciplinary action within the prescribed time limit.
The Decree stipulates disciplinary measures applied to cadres, including: Reprimand; warning; dismissal, applicable to cadres approved, appointed or appointed to hold positions and titles; dismissal.
Disciplinary measures applied to civil servants: Reprimand; warning; dismissal, applied to civil servants in leadership and management positions; forced to resign.
Thus, Decree No. 172/2025/ND-CP has removed the disciplinary measure of dismissal from office applied to civil servants holding leadership and management positions and lowered the salary for civil servants not holding leadership and management positions as stipulated in Decree No. 71/2023/ND-CP.
This change is to comply with the Law on Cadres and Civil Servants 2025 because this law does not stipulate the above two forms of discipline.
The form of disciplinary action for forced resignation of civil servants who commit violations in one of the following cases:
1. Disciplinary action has been taken in the form of dismissal of civil servants holding leadership and management positions or warning civil servants who do not hold leadership and management positions but re-offend.
2. Committing a first-time violation causing very serious consequences in one of the cases of applying a disciplinary reprimand or Clause 3, Article 9 of Decree No. 172/2025/ND-CP, but the violator does not have an attitude of accepting, correcting, proactively remedying the consequences and is one of the cases where the disciplinary level is increased.
3. Using fake or illegal degrees, certificates, certificates, and certificates to be recruited into agencies, organizations, and units.
4. Drug addiction; in this case, there must be a conclusion from a medical facility or a notice from a competent authority.
Officials who violate the provisions of the Law on Organization of the National Assembly, the Law on Organization of Local Government, the Law on Election of National Assembly deputies and People's Council deputies and other relevant legal provisions will be dismissed. The authority, order, and procedures for dismissal shall comply with the provisions of law.
