Mr. Pham Ngoc Luong (name of the character changed) said that he worked in the People's Police force from September 2014 to September 2023. From November 2023, he transferred to work in the Inspectorate sector and was appointed to the rank of Inspector in October 2025.
He requested the Ministry of Home Affairs to answer whether his case is entitled to preserve the seniority allowance level he is enjoying at the time of transferring to another sector and to add up the time to calculate seniority allowance for the Inspection sector from the time he is appointed to the rank of Inspector according to the provisions of point c, clause 1, Article 4 of Decree No. 49/2019/ND-CP and Article 3 of Joint Circular No. 04/2009/TTLT-BNV-BTC or not.

The Ministry of Home Affairs said that, according to point c, clause 1, Article 4 of Decree No. 49/2019/ND-CP, officers and non-commissioned officers receiving salaries, and police workers when transferring to other sectors are entitled to preserve the seniority allowance they were receiving at the time of transfer if the new job has a seniority allowance regime.
At the same time, Article 3 of Joint Circular No. 04/2009/TTLT-BNV-BTC stipulates that the working time that has been calculated for seniority allowance in industries and professions with seniority allowance regimes is added to the working time in the Inspection sector to calculate seniority allowance for the Inspection sector.
The organization of policy implementation for officials, civil servants, and public employees of the inspection sector is under the authority of the Government Inspectorate. Therefore, the Ministry of Home Affairs requests you to contact the Government Inspectorate for answers.
