The Ministry of Home Affairs has completed and sent its opinions on the draft Submission and draft Law on Cadres and Civil Servants as amended.
The draft Law on cadres and civil servants amended basically and comprehensively the provisions of the Law on current cadres and civil servants, provisions on cadres and civil servants; Election, recruitment, use and management of cadres and civil servants; obligations and rights of cadres and civil servants and conditions to ensure public service execution.
The bill is expected to be submitted to the National Assembly at the upcoming 9th session.
In Chapter IV on management of cadres and civil servants, the draft law clearly states: The Government unifies state management of cadres and civil servants in state agencies.
The Ministry of Home Affairs is responsible to the Government for implementing state management of cadres and civil servants in state agencies; implementing the contents of state management of cadres and civil servants according to the assignment and decentralization of the Government;
Ministries, ministerial-level agencies, and provincial People's Committees, within the scope of their tasks and powers, shall manage and use cadres and civil servants; carry out state management contents according to the assignment and decentralization of the Government;
The People's Committee at the commune level, within the scope of its tasks and powers, shall manage and use cadres and civil servants according to the decentralization of the Provincial People's Committee.
The competent authority of the Vietnam Cultural Party, the Vietnam Fatherland Front, and socio-political organizations within the scope of their functions and tasks shall manage and use cadres and civil servants according to the decentralization of competent authorities and according to Government regulations.
Regarding the authority to decide and manage the payroll of cadres and civil servants, the Ministry of Home Affairs proposes that the decision on the payroll of cadres and civil servants be implemented according to the regulations of the competent authority.
The National Assembly Standing Committee shall manage the staffing of the National Assembly agencies, the National Assembly Standing Committee and the National Assembly Office;
The Government shall manage the payroll of ministries; ministerial-level agencies; Government agencies; organizations established by the Government and the Prime Minister; Vietnamese representative agencies abroad;
The Office of the President assists the President in managing the staffing of the Office of the President;
The Supreme People's Court shall manage the staffing of the People's Courts;
The Supreme People's Procuracy manages the staff of the Procuracy;
The State Audit conducts the management of the State Audit payroll.
