Nam Dinh province has requested the Ministry of Home Affairs to provide specific and timely guidance on the contents related to resolving regimes and policies for commune-level cadres, civil servants, and part-time commune-level workers who are redundant after the rearrangement of district- and commune-level administrative units.
Responding to this content, the Ministry of Home Affairs said: Pursuant to Conclusion No. 48-KL/TW dated January 30, 2023 of the Politburo and Resolution No. 35/2023/NQ-UBTVQH dated July 12, 2023 of the National Assembly Standing Committee on the arrangement of district and commune-level administrative units for the 2023-2025 period, the Government issued Resolution No. 117/NQ-CP dated July 30, 2023 on the Plan for implementing the arrangement of district and commune-level administrative units for the 2023-2025 period and Decree No. 29/2023/ND-CP dated June 3, 2023 regulating staff streamlining;
The Ministry of Home Affairs issued Document No. 4099/HD-BNV dated July 29, 2023 providing guidance on the arrangement and consolidation of the organizational apparatus, implementation of policies for cadres, civil servants, public employees, workers and the recognition of safe zones, safe zone communes, island communes, Heroic units of the People's Armed Forces, and Labor Heroes when implementing the arrangement of administrative units at the district and commune levels in the period 2023-2030.
Regarding some reflections and recommendations of the People's Committee of Nam Dinh province related to resolving the regime and policies for commune-level cadres, civil servants, and non-professional commune-level workers who are redundant after the arrangement of administrative units at the district and commune levels in the period 2023-2025, the Ministry of Home Affairs has issued Documents No. 5696/BNV-CQDP dated September 16, 2024 and Document No. 6613/BNV-CQDP dated October 18, 2024 in response to the localities.
According to Lao Dong's investigation, Director of the Department of Local Government (Ministry of Home Affairs) Phan Trung Tuan issued Document No. 5996 in response to Document No. 2230 of the Department of Home Affairs of Nam Dinh province.
According to Document No. 5996, in the case of commune-level officials who are Heads of commune-level socio-political organizations, after the administrative unit arrangement, they are elected to hold the position of Deputy Head of commune-level socio-political organizations, Clause 1, Article 12 of Resolution No. 35/2023/NQ-UBTVQ shall apply.
Accordingly, they are entitled to reserve the salary and leadership allowance regimes and policies of the Head level until the end of the election term; in case the remaining term of the election term is less than 6 months, the full 6 months will be reserved;
After the reserved period expires, salary and position allowance (if any) will be implemented according to the current position or title or retirement regime will be resolved according to regulations.
The Ministry of Home Affairs requests the People's Committee of Nam Dinh province to base on the provisions of law and guiding documents of the Ministry of Home Affairs to organize implementation in the area.
During the implementation process, if there are any difficulties or problems, the Ministry of Home Affairs requests that localities promptly report to the Ministry for guidance on resolution within their authority or submit to competent authorities for resolution according to regulations.
