Mr. Nguyen Ngoc Quyen held the position of Chairman of the Farmers' Association of Hoa Bac commune, Di Linh district, Lam Dong province from December 1995 to May 1999.
After that, Mr. Quyen held the position of Vice Chairman of the Commune People's Council and retired in June 2004. His total continuous working time was 8 years and 5 months.
"So what benefits do I get when I quit my job?" - Mr. Quyen wondered.
Regarding the reflection and recommendation of Mr. Nguyen Ngoc Quyen, the Ministry of Home Affairs has responded.
In Clause 8, Article 38 of Decree No. 33/2023/ND-CP dated June 10, 2023 of the Government regulating commune-level cadres, civil servants and non-professional workers at the commune level, in villages and residential groups, it is stipulated that: Commune-level cadres who have paid social insurance according to the provisions of Decree No. 09/1998/ND-CP but have not yet received a one-time allowance, the working time with social insurance payment is counted as the time to receive social insurance or is added to the time participating in voluntary social insurance, compulsory social insurance to calculate the social insurance regime according to the provisions of the law on social insurance.
In cases where commune-level officials have been granted monthly or one-time allowances before the effective date of this Decree, the provisions of this Decree shall not be applied for re-settlement.
Therefore, the Ministry of Home Affairs recommends that Mr. Nguyen Ngoc Quyen contact the district social insurance agency for instructions on settlement procedures in accordance with regulations.
