Cadres who violate or are disciplined can still be planned in 3 cases
On behalf of the Politburo, Politburo member and Standing member of the Secretariat Tran Cam Tu has just signed and issued Regulation No. 377 on decentralization of cadre management and planning, appointing, introducing candidates, temporarily suspending work, removing from positions, resigning, and dismissing cadres.
Regarding cadre planning, Regulation 377 clearly states the principle of "only planning for higher positions". Each leadership and planning management position shall not exceed 3 cadres and each planning cadre shall not exceed 3 positions at the same level. The Politburo stipulates that the planning must not be implemented at the same time as the proposal to appoint and introduce candidates.
Notably, Regulation 377 of the Politburo clearly states that cadres who violate, have shortcomings or are disciplined or are in the process of investigation, inspection, examination, handling of denunciations, complaints, and considering responsibilities can be considered for higher position planning if they ensure the prescribed standards and conditions in 3 cases:
Firstly, there are violations and shortcomings that need to be reviewed and learned from, but not to the extent that disciplinary action must be considered.
Secondly, there are violations and shortcomings that must be reviewed, responsibilities considered, and disciplined, but the competent authority decides not to discipline or not to issue a disciplinary decision due to expiration (if disciplinary action is a form of reprimand due to direct responsibility, responsibility of the head or co-responsibility related to and has completed the review and remediation as required).
The third case is disciplinary action in the form of a reprimand or warning that has expired.
The Politburo noted that Party committees, Party organizations, and collective leadership of agencies and units should base on the situation of the staff, task requirements, analyze, evaluate objectively, cautiously, thoroughly, and consider many aspects of each case to consider, decide according to authority or report to competent authorities for consideration before planning.
The factors considered are the quality, capacity, reputation, results of work products of human resources; causes, motives of violations, shortcomings (perceptions, subjectivity) and nature, level, impact, influence, results have been remedied (if any)...
For cadres who have information exchanged by competent authorities about personal responsibility in cases, incidents, and conclusions that competent authorities have investigated, inspected, and checked but have not yet had official conclusions or have a proposal from competent authorities on reviewing and handling personal responsibility..., the Politburo stipulates "temporarily not reviewing the planning".
The Politburo also stated that there is no plan for cadres who are in the process of handling complaints and denunciations (there has been a decision to establish a complaint and denunciation team), being disciplined, being inspected when there are signs of violations or being considered and disciplined; cadres who are within the disciplinary period.
Conditions for planning age
Regulation 377 clearly states that the planning positions include: Party Central Committee member, Politburo member, Secretariat member; positions under the management of the Politburo, Secretariat and positions that must be consulted and appraised by Party committees and agencies at the Central level; positions under the management of Party committees at all levels, Party organizations, and collectives of leaders of agencies and units directly managed.
Article 25 of Regulation 377 stipulates the methods, standards, conditions, and planning age.
In which, cadres planned for the next term must be of working age for 2 terms or more, and must have completed at least 1 term (60 months). When reviewing and supplementing the annual plan for the current term, the cadres included in the plan must have reached the working age of at least 60 months or more.
According to the regulations of the Politburo, the structure and ratio of Party Committee planning and leadership and management positions should strive in the direction of: Young cadres (under 47 years old for central agencies; under 42 years old for provincial and commune levels) from 15% or more, female cadres from 25% or more. Cadres with scientific and technological qualifications of about 5-10%, the proportion of ethnic minority cadres suitable for each area and field.
