Mr. Dao Van Tu (character's name has been changed) was born on October 10, 1967, a civil servant working in the local health sector. During his working career, he has spent 34 years and 11 months participating in compulsory social insurance contributions.
On January 1, 2025, Mr. Tu received an early retirement decision according to Decree 29/2023 of the Government. However, it was not until June 26, 2025 that he was eligible for the support fund as prescribed in this decree.
During that time, he learned that Decree 178/2024 of the Government also took effect from January 1, 2025 - coinciding with the time he had a retirement decision.
Notably, according to him, Decree 178/2024 clearly states cases that have had a retirement decision from January 1, 2025 according to Decree 29/2023 but have not yet enjoyed the policy, but will still be applied according to the new regulations in Decree 178/2024.
From that reality, Mr. Tu wondered: Is it right or wrong for Yen Bai province (now Lao Cai province) to apply the regime for him according to Decree 29/2023 of the Government. He hopes that the authorities will consider, guide and give specific answers to ensure his rights according to regulations.
Regarding Mr. Tu's reflection and recommendation, the Ministry of Home Affairs responded on the Electronic Information Portal.
Cases of cadres, civil servants, public employees and commune-level cadres and public employees due to the arrangement of district and commune-level administrative units in the period of 2019 - 2021 and the period of 2023 - 2025 according to the Resolution of the National Assembly Standing Committee, who retire after January 1, 2025, are subject to the provisions of Point b, Clause 1, Article 2 of Decree No. 178/2024 (amended and supplemented in Decree No. 67/2025);
The above subjects, if they quit their jobs before January 1, 2025 or on January 1, 2025, will not be subject to the provisions of Decree No. 178/2024 (amended and supplemented in Decree No. 67/2025).
At the same time, in Decree No. 29/2023, Decree No. 178/2024 (amended and supplemented in Decree No. 67/2025), the Government has decentralized to the heads of agencies, organizations, units and People's Committees, Chairmen of provincial People's Committees to determine subjects and decide on approval.
Therefore, the Ministry of Home Affairs requests citizens to provide full information of individuals who need to ask, send to local authorities and competent authorities for answers according to regulations.
