Mr. Pham Van Hoai (name changed) wonders how the salary, allowance and bonus regime (if any) for civil servants working under contracts according to the provisions of Decree 173/2025/ND-CP is applied.
Regarding Mr. Hoai's proposal, the Ministry of Home Affairs has responded on the Electronic Information Portal.
According to the provisions of Clause 2, Article 10 of Decree 173/2025/ND-CP, for individuals signing contracts:
Fully and on time perform, ensure the quality of professional and nghiệp vụ tasks as agreed in the contract and other requirements of agencies, organizations, and units signing the contract (if any); be responsible before the law and agencies, organizations, and units for the results of implementation;
Only use information, documents, and equipment of agencies, organizations, and units serving assigned tasks; strictly prohibit misuse, leakage, loss, copying or illegal transfer of classified documents, assets or products assigned;
Being guaranteed conditions for performing tasks (professional capacity, supporting human resources, necessary tools and means... ) in accordance with the content of the contract and the requirements of agencies, organizations, and units;
Individuals who sign contracts are also paid salaries, bonuses, remuneration, and lease regimes corresponding to the results and products according to the agreement in the contract and according to the provisions of law;
Being guaranteed working conditions in accordance with the law, in accordance with the regulations of agencies, organizations, and units and in accordance with the agreement in the contract; having access to professional documents and necessary information to serve work in accordance with the regulations of agencies, organizations, and units;
The working time under labor contracts performing a number of professional and nghiệp vụ tasks specified in this Decree is calculated as the basis for ranking salaries according to job positions if recruited and received as civil servants and public employees. The ranking of salaries corresponding to the job position being recruited and received shall be implemented in accordance with the provisions of law;
This person must also be responsible for compensation for damages if they violate contract obligations causing financial losses, causing loss of property, damage to products or leaking confidential information and documents;
Compliance with the provisions of law on protecting state secrets, internal regulations, rules, and professional regulations of agencies, organizations, and units.
