The Ministry of Home Affairs has issued Official Letter 1814 guiding the implementation of Decree No. 178/2024 and Decree No. 67/2025 of the Government, which details 8 groups of beneficiaries of regimes and policies in implementing the arrangement of the apparatus in the political system.
Firstly, the subjects applying the policies and regimes according to Decree No. 178/2024 (amended and supplemented in Decree No. 67/2025) are implemented consistently according to the provisions of Article 2, not excluding those who have had a retirement decision or have had a retirement notice.
Secondly, cadres, civil servants and officials of management under the provisions of Decree No. 178/2024 (amended and supplemented in Decree No. 67/2025) are subjects subject to the direct impact of the organizational structure of the political system when the total number of cadres, civil servants and officials of leaders and management of the same level is higher than the regulations.
Third, for those working under the labor contract regime as prescribed in Point c, Clause 1, Article 2 of Decree No. 178/2024 (amended and supplemented in Decree No. 67/2025), including:
Employees who are working in agencies, organizations, and units due to organizational arrangement and have signed labor contracts under Decree No. 68/2000 before January 15, 2019, and are transferred to sign labor contracts under Decree No. 161/2018, Decree No. 111/2022 are subject to the provisions of Point c, Clause 1, Article 2 of Decree No. 178/2024 (amended and supplemented in Decree No. 67/2025).
Employees who are working in agencies, organizations, and units due to organizational arrangement and have signed labor contracts under Decree No. 68/2000 before January 15, 2019 and have terminated labor contracts; then sign labor contracts under Decree No. 161/2018 or Decree No. 111/2022 after January 15, 2019, are not subject to the provisions of Point c, Clause 1, Article 2 of Decree No. 178/2024 (amended and supplemented in Decree No. 67/2025).
Fourth, district-level cadres who are subjects specified in Clause 4, Article 2 of Decree No. 178/2024 (amended and supplemented in Decree No. 67/2025) will have their retirement period to enjoy policies and regimes calculated from the time the district level ends its activities according to the decision of the competent authority.
Fifth, cadres, civil servants, public employees and cadres and public employees at the commune level due to the arrangement of district and commune-level administrative units in the period of 2019-2021 and the period of 2023-2025 according to the Resolution of the National Assembly Standing Committee, who retire after January 1, 2025, are subject to the provisions of Point b, Clause 1, Article 2 of Decree No. 178/2024 (amended and supplemented in Decree No. 67/2025).
Sixth, civil servants and employees who are directly affected by the transfer of state management duties on drug rehabilitation and post-drug rehabilitation from the Department of Labor - Invalids and Social Affairs to the Department of Public Security but are not accepted by the Ministry of Public Security, cannot be assigned to other jobs and are at risk of retirement, the People's Committees at the provincial level are responsible for resolving policies and regimes according to the provisions of Decree No. 178/2024 (amended and supplemented in Decree No. 67/2025).
Seventh, cadres, civil servants, public employees and workers who have worked for 15 years or more in arduous, harsh, dangerous or especially arduous, harmful, dangerous jobs or have worked for 15 years or more in areas with special socio-economic conditions or difficulties.
Eighth, those working at the Parties are assigned tasks by the Party and the State at the central level, at the provincial and district levels.
