The Government has just issued Decree No. 154/2025/ND-CP regulating staff streamlining, which stipulates the subjects, principles, staff streamlining policies and the responsibility for staff streamlining in agencies, organizations, public service units of the Party, State, Vietnam Fatherland Front, and socio-political organizations from central to commune level.
The Decree stipulates 5 groups of subjects implementing the staff streamlining policy, including:
1. Cadres, civil servants, public employees; commune-level cadres, civil servants and people working under labor contracts are subject to the same regime and policies as civil servants as those prescribed by the Government (abbreviated as workers).
2. People working under labor contracts do not determine the duration of performing professional and technical work on the list of professional title positions and professional title positions shared in public service units according to the Government's regulations that are redundant due to the restructuring of the unit's human resources according to the decision of the competent authority or redundant due to the reorganization of the apparatus (except for subjects enjoying policies and regimes in implementing the reorganization of the apparatus of the political system according to the Government's separate regulations).
3. People working under unlimited labor contracts shall perform support and service work in administrative agencies and public service units according to the provisions of law due to redundant organizational apparatus arrangement (except for subjects enjoying policies and regimes in implementing organizational apparatus arrangement of the political system according to separate regulations of the Government).
4. Part-time workers at the commune level will retire immediately from the implementation of the 2-level local government model according to the provisions of the Law on Organization of Local Government.
5. Non-professional workers in villages and residential groups who are redundant due to the arrangement of villages and residential groups will retire immediately after the decision on arrangement is issued by the competent authority.
Notably, according to the proposal of the Ministry of Home Affairs, the decree stipulates that there are 2 groups of subjects that have not yet implemented staff streamlining, including:
- Those who are pregnant, on maternity leave, or raising children under 36 months old, except for individuals who voluntarily streamline their staff.
- Those who are under disciplinary review or criminal prosecution or are being inspected or examined for signs of violations.
