On the afternoon of May 27, the National Assembly listened to the presentation and report on the review of the draft Law on Emergency Situations.
Presenting the report, General Phan Van Giang - Politburo member, Minister of National Defense - stated that the draft law is arranged in 6 chapters, with 42 articles.
Chapter I, including 8 articles, stipulates the scope of regulation; principles of operation in emergency situations; application of the Law on Emergencies and related laws; prohibited acts; international cooperation on emergency situations.
Chapter II, including 4 articles stipulating the authority, order and procedures for issuing, announcing, extending and abolishing emergency; The contents of the Resolution issued, orders to announce the emergency status; Ending the effectiveness of legal documents on the organization of the implementation of the Resolution to issue and the order to announce the emergency status.
According to General Phan Van Giang, the law stipulates that based on the developments of natural disasters, epidemics, national defense and security, social order and safety, and based on the proposal of ministries or Chairmen of provincial People's Committees, the Prime Minister shall propose the National Assembly Standing Committee to declare a state of emergency.
In case the Standing Committee cannot meet immediately, the Prime Minister shall propose to the President to declare a state of emergency in the whole country or in each locality.
Also according to the draft law, the Prime Minister decides on the application of measures in emergency situations.
If necessary, the Prime Minister can apply measures that are not regulated by current law and report to the competent authority of the Party and the National Assembly as soon as possible.
Chapter III, including 12 articles, stipulates measures applied in times of emergency when there are major disasters such as natural disasters, environmental pollution, radiation and nuclear incidents, epidemics, in times of emergency such as national security and order, social safety, national defense.
Regulate remedial measures; mobilize resources, relief, support; regimes and policies for organizations and individuals participating in responding to and overcoming emergency situations.
The law stipulates that in case of necessity, the Prime Minister may apply measures that the current law has not stipulated and reported to the competent authorities of the Party and the National Assembly in the nearest time to comply with the provisions of the Government Organization Law in 2025.
The Chairman of the Provincial People's Committee decides to apply measures that are not regulated by current law and reports to the competent authorities of the Party and the Prime Minister as soon as possible to comply with the provisions of the Law on Organization of Local Government 2025.
The law stipulates that if necessary, the Prime Minister shall request the President to mobilize armed forces to the area to declare a state of emergency for national defense, security, and social order and safety.
The Minister of National Defense and the Minister of Public Security mobilize forces under their authority to come to the area to declare a state of emergency due to major disasters and epidemics to support local forces in rescuing and overcoming the consequences of natural disasters and epidemics or to stabilize, maintain security and order, and social safety.
