The Ministry of Home Affairs is seeking opinions on the draft Circular abolishing a number of legal normative documents issued by the Minister of Home Affairs and jointly issued by the Ministry of Home Affairs.
The draft includes 2 articles, of which Article 1 regulates the abolition of documents. According to the draft, 23 legal normative documents issued by the Minister of Home Affairs and jointly issued are proposed to be abolished.
Among these, there are 3 circulars related to the organization and operation of villages and residential groups.
Accordingly, the draft proposes to abolish Circular No. 04/2012/TT-BNV dated August 31, 2012 of the Minister of Home Affairs guiding the organization and operation of villages and residential groups.
According to the draft, the abolition of Circular No. 04/2012/TT-BNV is proposed due to the implementation of the Party's policy and the requirement to organize local governments at 2 levels, the Government has issued Decree No. 185/2026/ND-CP dated May 26, 2026 stipulating the organization and operation of villages and residential groups and regimes and policies for non-specialized workers in villages and residential groups.
Decree No. 185/2026/ND-CP has stipulated the organization and operation of villages and residential groups in accordance with the Party's guidelines and the 2-level local government organization model. Therefore, according to the draft, the regulations in Circular No. 04/2012/TT-BNV are no longer consistent with current legal regulations and need to be completely abolished.
The draft also proposes to abolish Circular No. 14/2018/TT-BNV dated December 3, 2018, amending and supplementing a number of articles of Circular No. 04/2012/TT-BNV.
The reason given is that the Government has issued Decree No. 185/2026/ND-CP regulating the organization and operation of villages and residential groups and regimes and policies for non-specialized workers in villages and residential groups, in accordance with the Party's policy and the 2-level local government organization model.
In addition, Circular No. 05/2022/TT-BNV dated May 23, 2022 amending and supplementing a number of articles of Circular No. 04/2012/TT-BNV is also proposed to be abolished.
According to the draft, because Circular No. 05/2022/TT-BNV amending and supplementing Circular No. 04/2012/TT-BNV and the contents on the organization and operation of villages and residential groups have been adjusted according to new regulations, Circular No. 05/2022/TT-BNV is no longer in accordance with current legal regulations. Therefore, the draft proposes to abolish the entire Circular.
