The Ministry of Justice appraises the draft Law amending and supplementing a number of articles of the Law on Social Insurance drafted by the Ministry of Home Affairs.
The draft Law amending and supplementing a number of articles of the Law on Social Insurance proposes to amend Article 10 of the Law on Social Insurance 2024, stipulating that the authorization of others to implement social insurance is valid for a maximum of 12 months.
Accordingly, the draft law stipulates written authorization for others to implement social insurance. The implementation of authorization is in accordance with the provisions of civil law.
The latest draft has removed the condition that the power of attorney is valid for a maximum of 12 months and the certification of documents according to the provisions of law on certification.
The Ministry of Home Affairs said that from the reflection of the social insurance agency and some localities, the regulation on authorizing pensions to be valid for 12 months has arisen some inadequacies in the processing of continued authorization when it expires.
This procedure prevents people with weak health from making a power of attorney and also incurs costs in the case of having to make a power of attorney at a Notary Office.
Previously, many elderly people shared their desire to extend the time to execute the power of attorney for relatives to receive pensions. Because they are old and weak, they will have difficulty in carrying out administrative procedures.
Compared to the draft law consulted in June, the draft being appraised by the Ministry of Justice has removed one option of keeping the current regulations and keeping the proposal to remove the regulation requiring each year to authorize the receipt of pensions once.
Recently, Hanoi City Social Insurance said that as of the morning of July 21, the whole city has completed the supplementation of authorization documents for 90,105/92,364 cases of enjoying pensions and social insurance allowances, reaching 97.55% according to Plan 271/KH-UBND of the City People's Committee on organizing the inter-sectoral peak period to ensure the non-interrupted payment of pensions and social insurance allowances.
Currently, 2,259 cases are continuing to be supported by grassroots Social Insurance in coordination with Shock Public Administration Teams and local authorities to complete procedures.
