The Ministry of Home Affairs is seeking opinions on the draft Circular Regulating the list and periodic term of job transfer for civil servants and public employees who do not hold leadership and management positions and the list and term for people with positions and powers not to establish or hold management and operating positions of private enterprises, limited liability companies, joint-stock companies, partnerships, and cooperatives after ceasing to hold positions and powers in areas under the management of the Ministry of Home Affairs.
The list of fields under the management scope of the Ministry of Home Affairs in which people with positions and powers are not allowed to establish, hold titles and management and administration positions in enterprises in that field after resigning from their positions and powers includes: Archives; Employment; Vocational skills; Occupational safety and hygiene; Sending Vietnamese workers to work abroad under contracts; Programs, projects, and schemes in the fields specified by the person who resigns from their positions and powers when they are officials, civil servants, and public employees directly researching, developing or appraising, and approving.
Notably, the Ministry of Home Affairs proposed a deadline for people with positions and powers not to establish, hold titles and positions of management and administration of enterprises in that field after ceasing to hold positions and powers.
For people who do not hold leadership or management positions: The deadline for not being allowed to establish or hold management and administration titles and positions in enterprises in the fields specified in this Circular is 12 months from the date of dismissal according to the decision of the competent authority.
For people holding leadership and management positions: The deadline for not being allowed to establish, hold management and administration titles and positions in enterprises in the fields specified in this Circular is 24 months from the date of resignation according to the decision of the competent authority.
For people who cease to hold positions and powers while directly working on researching, developing or appraising, approving programs, projects, and schemes in this Circular, the deadline for not establishing or holding management and administration titles and positions of enterprises is the deadline for completing programs, projects, and schemes according to the approval decision or confirmation of the competent authority.
