This content is stated in Decree 309/2026/ND-CP of the Government amending and supplementing a number of articles of Decree No. 118/2025/ND-CP on implementing administrative procedures according to the one-stop shop mechanism, inter-agency one-stop shop at the One-Stop Shop Department and the National Public Service Portal, amended and supplemented by Decree No. 367/2025/ND-CP.
Decree 309/2026/ND-CP amending and supplementing point c, clause 2, Article 10 stipulates that employees working at the Provincial-level Public Administrative Service Center (PVHCC) are as follows:
Provincial-level Public Administration Service Centers, one-level Public Administration Service Centers have civil servants, public employees, and staff under the Center's management to perform tasks; cadres, civil servants, and public employees sent by provincial-level specialized agencies, vertical sector agencies (if any); personnel of public postal service providers, service providers to perform support work under signed labor contracts.
For people working at commune-level PVHCC Centers, Decree 309/2026/ND-CP amends and supplements Clause 3, Article 10 as follows:
At the commune-level PVHCC Center, leaders of the commune-level PVHCC Center include Directors equivalent to Heads of Departments, no more than 2 Deputy Directors equivalent to Deputy Heads of Departments under the commune-level People's Committee to assist the Director in performing one or more specific tasks assigned by the Director and be responsible to the Director and before the law for performing assigned tasks.
Commune-level PVHCC centers have civil servants and employees under the center's management; civil servants and employees of specialized departments; agencies under vertical sectors (if any) assigned to perform tasks; personnel of public postal service providers, service providers to perform support work under signed labor contracts.
The Decree also stipulates that for central agencies organized according to the vertical sectoral system in localities, the head of the vertical sectoral agency decides to organize the Receipt and Result Return Department.
In case the head of the vertical industry agency does not organize the Department of Receiving and Returning Results at their agency, cadres, civil servants, and public employees should be arranged to come to the Provincial-level PVHCC Center, and the Commune-level PVHCC Center where the vertical industry agency has its headquarters to receive and resolve administrative procedures.
At the same time, Decree 309/2026/ND-CP amends and supplements point b, clause 2, Article 7 of the Organization of the One-Stop Shop at the provincial level as follows:
In cities, based on the specific characteristics of population management, digital infrastructure conditions, assessing the level of application of science, technology, innovation and digital transformation in the city, the City People's Committee submits to the City People's Council to decide on the establishment of a provincial-level PVHCC Center as an administrative organization directly under the City People's Committee (hereinafter referred to as a single-level PVHCC Center) and decides on the number of Branches, Receiving and Result Return Points directly under the single-level PVHCC Center to perform tasks within the locality.
In case this model is not selected, the City People's Committee decides to establish a provincial-level PVHCC Center according to regulations.
Decree 309/2026/ND-CP takes effect from August 5, 2026.
