Mr. Nguyen Van Phong (character name changed) currently works at the public administrative service center of the ward in Dong Nai province, recruited as a civil servant in 2021 with the rank of intermediate librarian (rank code 02.008).
In 3 years of work, he had 1 year of excellent task completion and 2 years of good task completion, participated in professional training classes and graduated from university with a degree in Information Technology. He believes that his expertise is consistent with the criteria in Article 31a of Decree 116/2024/ND-CP.
From there, Mr. Phong requested to be answered whether he could transfer from the intermediate librarian rank to the specialist rank (rank code 01.03) or not. At the same time, he also wondered whether with the current intermediate librarian rank, he is eligible to be appointed to the position of Deputy Head of Department according to Resolution 132/NQ-CP or not?
Answering this content on the Electronic Information Portal, the Ministry of Home Affairs said: On December 31, 2025, the Government issued Decree No. 361/2025/ND-CP, so the ranking of civil servant ranks according to job positions is proposed to be implemented according to the provisions of Article 9 of Decree No. 361/2025/ND-CP.
Accordingly, the principle of ranking civil servant ranks according to job positions is clearly stated: Civil servants are assigned to which job position to be ranked according to that job position. Ranking civil servant ranks according to job positions for professional and nghiệp vụ civil servants must be based on the job description, capacity framework of the job position;
Civil servants appointed to leadership and management positions as deputy heads of agencies and organizations (not applicable to civil servant positions as Deputy Ministers and equivalents), heads and deputy heads of organizations under and directly under agencies and organizations when ranked into ranks according to job positions specified in this Decree must meet the requirements of professional and nghiệp vụ job positions in corresponding ranks used in their agencies and organizations;
The ranking of civil servant ranks according to leadership and management positions as heads does not apply to people assigned powers;
The ranking of civil servant ranks according to job positions specified in Clauses 2 and 3 of this Article must ensure the correct rate decided by the competent authority approving job positions in Clause 5, Article 7, Clause 4, Article 8 of this Decree.
