The Ministry of Home Affairs proposes a compensation policy for cadres when streamlining

The Ministry of Home Affairs proposes that cadres who have enjoyed the policy under Decree No. 29/2023 from January 1, 2025 will be compensated according to the policies and regimes in Decree 178/2024/ND-CP.

The Ministry of Home Affairs has drafted a Decree amending and supplementing a number of articles of Decree No. 178/2024/ND-CP (Decree No. 178) of the Government on policies and regimes for cadres, civil servants, public employees, workers and armed forces in implementing the restructuring of the apparatus of the political system.

According to the submission of the Ministry of Home Affairs, in the process of implementing Decree No. 178, many ministries, branches, central and local agencies have made recommendations and proposals related to the scope and subjects of the Decree.

On that basis, the Ministry of Home Affairs reports to the Government Party Committee to report to the Politburo to expand the scope and subjects of application of Decree No. 178.

Up to now, the Politburo has agreed to adjust the scope and subjects of policy and regimes for cadres, civil servants, public employees, workers and armed forces in implementing the organizational arrangement of the political system in Conclusion Notice No. 75.

To institutionalize the Politburo's policy and unify the implementation of Decree No. 178, the Ministry of Home Affairs proposed amending and supplementing the scope of regulation and subjects of application.

Also in the draft revised Decree, the Ministry of Home Affairs proposed to amend and supplement Clause 2 and Clause 3, Clause 4, Article 24 of Decree No. 178/2024 as follows:

Cases eligible for the policies and regimes prescribed in this Decree that have been resolved by competent authorities under Decree No. 29/2023/ND-CP from January 1, 2025 will be compensated according to the policies and regimes in this Decree.

In cases where policies and regimes have been resolved by competent authorities according to Decree No. 177/2024/ND-CP from January 1, 2025 to before the effective date of this Decree, if the policies and regimes are lower than the policies and regimes prescribed in this Decree, compensation will be granted according to the policies and regimes in this Decree.

Cases that have been decided by competent authorities to retire early before the deadline of January 1, 2025 according to the provisions of Decree No. 21/2009/ND-CP dated February 23, 2009 of the Government detailing and guiding the implementation of a number of articles of the Law on Officers of the Vietnam People's Army on regimes and policies for officers who have ceased to serve in the army; officers on active duty, who have died; officers on active duty transferred to professional soldiers or defense civil servants (amended and supplemented in Decree No. 52/2025/ND-CP dated March 1, 2025 of the Government); Decree No. 1516/ND-CP dated November 11, 2016 of the Government detailing a number of articles and policies of the National Defense Police, professional soldiers and civil servants; Decree No. 32/CP dated March 1, 2013 and Decree No. 32/CP dated March 1, 2013 on personnel and public employees, but not yet issued in the Government's Decree No. 3225/CP dated March 1, 2013 on personnel and public employees, but not yet issued in the Government's Decree No. 32/CP dated March 1, 2023 on personnel and policies for civil servants and public employees.
