Minister of Home Affairs Pham Thi Thanh Tra - Standing Deputy Head of the Government Steering Committee on arranging administrative units at all levels and building a model of organization of local government 2 levels - has just signed Official Letter No. 03 to the Provincial Party Committee, City Party Committee, People's Committee of the province and city on orientation of a number of tasks in arranging administrative units.
Official dispatch stated the organizational structure, provincial government (provinces and centrally -run cities) basically remain the same as the current model.
The provincial level has People's Council and People's Committee. In particular, the provincial People's Council organizes 3-4 specialized committees to assist.
Accordingly, the provincial People's Council established 3 committees, including: Legal Department, Economic - Budget Committee, Culture and Social Committee (for the province with many ethnic minorities that can establish more ethnic minorities).
The People's Council of the City under the Central Government established 4 boards (Legal Department, Economic - Budget Department, Culture - Social Committee and Urban Committee) in accordance with the Law on Organization of Local Government in 2025.
The provincial People's Committee organizes a maximum of 14 departments and equivalent (Hanoi and Ho Chi Minh City alone organized up to 15 departments and equivalent) according to the Government's regulations.
The organization of agencies under the People's Council, specialized agencies and other administrative organizations under the provincial People's Committee formed after the arrangement was allowed to enter the status quo of the provincial People's Council agencies organized unified in localities and the Office of the National Assembly delegation and the provincial People's Council in accordance with the regulations of the National Assembly Standing Committee.
In case the People's Council in one of the provinces before the organization of the Ethnic Minority Committee, the provincial People's Council after arranging is also organized by this specialized committee to operate until the end of the term 2021-2026, then comply with the Law on Organization of the local government.
The guiding dispatch also clearly stated that the status quo of specialized agencies under the provincial People's Committee was uniformly organized in localities. For specific specialized agencies under the provincial People's Committee, the organization is organized by the provincial government after arranging and deciding appropriately.
The Government assigned the Provincial People's Committee to base on the conditions of socio -economic development, the natural area, the population size of the administrative unit to decide the number of specialized agencies under the People's Committee accordingly (but not exceeding 4 rooms and equivalent).
The number of cadres, civil servants and public employees of the provincial administrative unit after the maximum arrangement does not exceed the total number of cadres, civil servants and public employees (the number of presence) of the provincial level before arranging and streamlining the payroll associated with restructuring, improving the quality of the team according to the roadmap, ensuring that within 5 years of the number of payrolls comply with regulations.
After the provincial local authorities put into operation, the Government assigned the Ministry of Home Affairs to coordinate with the Central Organizing Committee and relevant agencies based on the population size, natural area, functions, tasks and powers of the provincial local government to build the job position submitted to the competent level to assign the local payroll to the locality.
