Clause 2, Article 3 of Decree 190/2026/ND-CP detailing a number of articles of the Law on Emergency Situations (effective from July 13, 2026) stipulates salaries, wages, allowances and support for unpaid people from the state budget who are mobilized and mobilized to perform tasks in an emergency situation according to the decision of the competent authority as follows:
a) During the time they are mobilized to perform tasks in a state of emergency according to the decision of the competent authority, they are entitled to allowances for working days and meals as for the militia mobilized to perform tasks according to the Decree detailing a number of articles of the Law on Militia and Self-Defense Forces on organizing force building and regimes and policies for militia and self-defense forces;
b) In case of performing duties at night (from 10 PM the previous day to 6:00 AM the next day), they are entitled to an additional working day allowance not less than 50% of the current working day allowance level at point a of this clause;
c) In addition to the items specified in points a and b of this clause, they are entitled to an additional working day allowance due to hazards and dangers when performing tasks in an emergency situation calculated according to the actual working day, with the following benefit levels:
Level 1: Equal to 0.5 times the labor day allowance level specified in point a of this clause when performing tasks in an emergency situation.
Level 2: Equal to 0.7 times the labor day allowance level specified in point a of this clause when performing dangerous, toxic tasks or working in areas affected by natural disasters, epidemics, and serious disasters.
Level 3: Equal to 1.0 times the labor day allowance level specified in point a of this clause when performing tasks in an emergency situation with particularly toxic and dangerous elements, with a high risk of affecting life and health;
d) For employees working at enterprises and organizations that do not receive salaries from the state budget, during the time they are mobilized to perform tasks in an emergency situation according to the decision of the competent authority, the mobilized agency shall pay working day allowances, meal allowances and additional working day allowances and other regimes as prescribed in Clause 2 of this Article; enterprises and organizations pay salaries during the mobilized period not lower than the regional minimum wage prescribed by the Government at the time of performing tasks and are included in production and business management costs.
Thus, from July 13, 2026, people who do not receive salaries from the state budget who are mobilized to perform tasks in an emergency situation will receive the above allowance.
