Regulations on assigning civil servants from August 2026

Article 10 of Decree 300/2026/ND-CP (effective from August 1, 2026) stipulates the amendment and supplementation of Article 26 of Decree No. 170/2025/ND-CР stipulating the assignment of civil servants as follows:

1. Civil servant assignment is carried out in the following cases:

a) According to unexpected and urgent tasks;

b) To perform work that needs to be resolved in a certain period of time.

2. The departure period for civil servants does not exceed 03 years, except for cases implemented according to the provisions of law on the industry and field. When the departure period expires, the agency, organization, and unit assigning the departure shall consider and decide on the termination or extension of the departure period for civil servants; only extend the departure period for cases where unexpected and urgent tasks have not been completed due to objective reasons.

When the probation period ends, civil servants return to their old units for work. The head of the agency, organization, or unit assigned for probation is responsible for arranging suitable job positions for civil servants.

3. Dispatched civil servants are subject to the assignment, arrangement, evaluation, and inspection of the performance of tasks of agencies, organizations, and units receiving the dispatch; belong to the staffing and structure of the number of leadership and management titles (if any) of agencies, organizations, and units dispatched, including cases where leadership and management civil servants are dispatched.

Thus, from August 1, 2026, the assignment of civil servants is regulated as above.
