Article 2 of the 2025 Law on Digital Transformation (effective from July 1, 2026) stipulates the subjects of application as follows:
This law applies to agencies, organizations, and individuals at home and abroad who directly participate in or are related to digital transformation in Vietnam.
Clause 7, Article 3 of the 2025 Law on Digital Transformation stipulates as follows:
7. The digital environment is an operating space, interaction, transaction and service provision that is formed and operated through digital infrastructure, public digital infrastructure, digital systems, digital platforms and digital data.
Article 41 of the 2025 Digital Transformation Law stipulates human rights and citizens' rights in the digital environment as follows:
1. Human rights, citizen rights are recognized, respected, protected and not denied just because they are exercised in a digital environment.
2. Register, use and manage electronic identity accounts, electronic transaction accounts, and digital signatures in accordance with the law on electronic identification and authentication, and electronic transactions.
3. Be protected personal data according to the law on personal data protection.
4. Be popularized with basic digital capabilities.
5. Be allowed to choose to use or stop using digital products and services on the basis of being provided with complete, clear, accurate, transparent, and timely information about terms and conditions of use; not being imposed unreasonable conditions or discriminated against when using digital products and services.
6. Be guaranteed fair and safe access conditions, especially vulnerable subjects in the digital environment.
7. Be required by competent authorities to protect legal rights in the digital environment.
8. Being guaranteed the rights of citizens according to the provisions of relevant laws.
Thus, from July 1, 2026, citizens' rights in the digital environment are regulated as above.
