Clause 6, Article 1 of Decree 55/2026/ND-CP amending and supplementing a number of articles of Decree No. 63/2019/ND-CP stipulating penalties for administrative violations in the field of public asset management; practicing thrift, combating wastefulness; national reserves; state treasury has been amended and supplemented by Decree No. 102/2021/ND-CP (effective February 9, 2026) as follows:

6. Amending and supplementing Article 10 as follows:

Article 10. Sanctions for violations of regulations on donation of public property

1. Fines are imposed on organizations and individuals who have acts of donating public property not in accordance with regulations (using public property as gifts in violation of gift-giving regulations issued by competent agencies and people) but not to the extent of criminal prosecution according to the following penalties.

a) From 2 million VND to 5 million VND in case of donating public property worth less than 50 million VND;

b) From 5 million VND to 10 million VND in cases of donating public property from 50 million VND to less than 75 million VND;

c) From 10 million VND to 50 million VND in cases of donating public assets worth 75 million VND or more.

2. Remedial measures: Forced return of assets.

Thus, from February 9, 2026, donations of public property that are not in accordance with regulations but have not reached the level of criminal prosecution will be fined up to 50 million VND according to the above regulations.
