On July 30, at a press conference providing information on the socio-economic situation of Ho Chi Minh City, Ms. Nguyen Thi Ngoc Hang - Deputy Head of the Art Department, Department of Culture and Sports of Ho Chi Minh City - responded to a question from Lao Dong Newspaper related to Á hậu My Duyen throwing stones at people's houses and the case of former Miss Dieu Van going to appraise a 3-billion VND crown to find it fake.
According to Ms. Nguyen Thi Ngoc Hang, Decree 144/2020/ND-CP of the Government stipulates that beauty and model contests organized in which locality will be under the management, inspection and handling authority of the state management agency in that locality.
The above-mentioned competitions do not take place in Ho Chi Minh City, so they are not under the authority to consider and resolve of the Ho Chi Minh City Department of Culture and Sports" - Ms. Hang said.
For a beauty or model contest, organizations or individuals wishing to implement it must prepare a dossier requesting approval from a competent authority. The organizing project needs to clearly state the purpose, content, rules, titles, awards and the rights and responsibilities of the organizing committee and contestants.
The organizing committee must also stipulate handling measures for cases of violation of regulations or failure to properly implement commitments. This is the basis for considering responsibility when disputes arising regarding prizes, titles or the actions of the winner.
Based on the submitted dossiers, state management agencies conduct appraisal, issue approval documents and carry out inspection and supervision work. If violations are detected, competent authorities at the contest venue will consider and handle them according to regulations.
According to Article 16 of Decree 144/2020/ND-CP, the competent authority to approve the organization of beauty and model contests is the Provincial People's Committee where the contest takes place. The Chairman of the Provincial People's Committee is responsible for directing subordinate agencies to carry out management work, ensuring that the contest is organized in accordance with the law.
Specifically for cases where contestants or title-winning people violate regulations, commitments or have after-contest scandals such as the case of the crown appraisal of former Miss Dieu Van, representatives of the Ho Chi Minh City Department of Culture and Sports said that the responsibility for consideration and handling first belongs to the organizing committee.
According to regulations, competent state agencies may request the organizing unit to revoke the title, award or cancel the results if violations are detected that must be handled. However, this needs to be based on the dossier, contest regulations, verification results and decisions of the competent authority.
