Reporting to the Ministry of Public Security's Electronic Information Portal, Ms. Nguyen Thi Ninh (character's name has been changed) wondered whether, through social networks Facebook and Zalo, individuals calling for support for cases of serious illness, traffic accidents, dialysis, poor circumstances... using their personal accounts would violate the law?
Are there specific regulations on calling for support through personal accounts? Does that individual have to prove the amount of money everyone donated?
Responding to the above question, the Ministry of Public Security said: The mobilization, reception, distribution and use of voluntary contributions to support overcoming difficulties caused by natural disasters, epidemics, incidents; supporting patients with serious illnesses, is carried out in accordance with the provisions of Decree No. 93/2021/ND-CP dated October 27, 2021 of the Government.
Accordingly, the State encourages, honors and creates favorable conditions for organizations and individuals to participate in voluntary contributions and organizes voluntary contribution campaigns.
The law does not prohibit individuals from calling for support for cases of serious illness, traffic accidents, dialysis, poor circumstances... through their personal accounts through social networks Facebook and Zalo for humanitarian purposes.
However, individuals must be public, transparent, for the right purpose, to the right subjects and comply with the provisions of Decree No. 93/2021/ND-CP dated October 27, 2021 of the Government.
In case of fraudulent acts (constructing, fake information, pretending victims ...) in order to appropriate property; use money to support the wrong purpose or win; adversely affecting the security, order and public opinion, based on the nature, extent and individuals that violate will be administratively handled or criminally handled on crimes prescribed by the Criminal Code (crime "Fraudulent appropriation of property", prescribed in Article 174 of the Penal Code; Crime of "abuse of property appropriation", as prescribed in Article 175 of the Criminal Code ...).
According to the Ministry of Public Security, the call for support through personal accounts is implemented according to the provisions of Section 2, Section 4, Decree No. 93/2021/ND-CP dated October 27, 2021 of the Government.
Accordingly, individuals who mobilize must open a separate bank account at each campaign to receive and manage the entire amount of voluntary contributions, and are responsible for opening a book recording full information about the results of receiving and distributing voluntary contributions according to the supported subjects and areas and publicizing the results of use to prove the entire amount of mobilized and used.
