The State Appraisal Department of Construction Quality, Ministry of Construction has just issued an Official Dispatch responding to a question from citizen L.T.Q.L about the decentralization of construction works.
Previously, citizen L.T.Q.L asked: The social housing construction project is being implemented simultaneously, including 6 independent buildings, each building has a construction floor area of about 17,000 m2. When determining the construction level, for calculating the total area of 17,000 m2 x 6 buildings, is the construction level considered as a level I or is an independent building considered a level II project?
After studying, the Appraisal Department would like to answer as follows:
According to current legal regulations, the granting of construction works for the management of construction investment activities (including special level, level I, level II, level III and level IV) is regulated in detail in Circular No. 06/2021/TT-BXD dated June 30, 2021 of the Minister of Construction regulating the decentralization of construction works and instructions for application in the management of construction investment activities, which has been amended and supplemented in Circular No. 02/2025/TT-BXD dated March 31, 2025 of the Minister of Construction (hereinafter referred to as Circular 06/2021/TT-BXD).
The level of a project of an independent project is determined according to the provisions of Clause 1 (on decentralization criteria) and Clause 2 (on how to determine the level of a project) Article 2 of Circular No. 06/2021/TT-BXD.
For projects with a number of independent main works (similar to the project mentioned in the citizen's question) it is possible to see how to determine the grant of works and apply the grant of works as presented in the example in Section 3, Appendix III of Circular 06/2021/TT-BXD.
According to the transitional regulations in Article 4 of Circular 06/2021/TT-BXD, in case the above social housing project has been decided to invest before the effective date of Circular 06/2021/TT-BXD, the project's construction allocation is determined according to the provisions of law at the time of investment decision.
