The Inspectorate of the Ministry of Labor, War Invalids and Social Affairs (MOLISA) has just concluded an inspection on compliance with the provisions of the law on social insurance, unemployment insurance, health insurance, and occupational accident and disease insurance (SI, BHTN, BHYT, BHTNLD - BNN) at the Social Insurance of Can Tho City.
The Chief Inspector of the Ministry of Labor, Invalids and Social Affairs concluded that Can Tho still has 1,351 units that are late in paying social insurance, unemployment insurance, health insurance, and occupational accident and disease insurance (11,660 employees are late in paying with a total amount of more than 108 billion VND) under the responsibility of collection management of Can Tho City Social Insurance.
The amount of social insurance benefits received in violation of regulations has not been recovered for 15 cases with the total amount to be recovered being more than 1.4 billion VND.
The one-time social insurance subsidy difference due to adjustment of monthly salary for which social insurance has been paid has not been paid for 44 cases with a total amount to be paid of more than 34.5 million VND as prescribed.
The amount of unemployment benefits (TCTN) received incorrectly from 989 people has not been recovered, with a total amount to be recovered of more than 3.6 billion VND. The amount of vocational training support (HTHN) received incorrectly from 2 people, with a total amount to be recovered of 15 million VND.
Not calculating late payment interest for 49 cases of collecting social insurance, unemployment insurance, health insurance, and occupational accident and disease insurance due to late payment of 30 days or more; calculating late payment interest for 9 cases of collecting social insurance, unemployment insurance, health insurance, and occupational accident and disease insurance due to salary adjustment less than 6 months from the date of issuance of the salary adjustment decision is not in accordance with regulations.
There are 14 cases of foreign workers participating in compulsory social insurance but not eligible to participate; there is 1 case of taking sick leave for 14 working days or more in a month while still paying social insurance, which is not in accordance with regulations.
Resolve maternity benefits for 10 cases of female employees on maternity leave whose maternity leave period does not match the reduced social insurance payment period on the collection management software according to regulations.
Calculating the social insurance payment period for 3 cases of miscarriage benefits with leave period of less than 14 working days in a month is not in accordance with regulations...
Regarding the proposed handling measures, the Chief Inspector of the Ministry of Labor, Invalids and Social Affairs requested the Director of Can Tho City Social Insurance to correct the violations stated in the inspection conclusion.
Accordingly, preside over and coordinate with relevant agencies to review and collect social insurance, unemployment insurance, health insurance, and occupational accident and disease insurance from 1,351 employers who are late in paying (with a total amount of more than 108 billion VND); recover the amount of social insurance benefits that are not in accordance with regulations for 15 cases with a total amount of more than 1.4 billion VND.
Coordinate with the Department of Labor, Invalids and Social Affairs to completely recover the amount of social insurance benefits that were received in violation of regulations (989 people receiving social insurance benefits and 2 people receiving unemployment benefits) with a total amount of more than 3.6 billion VND.
Direct, guide and urge district and commune Social Insurance agencies to overcome the shortcomings stated in the inspection conclusion. Review and draw lessons from organizations and individuals that have caused the shortcomings stated in the inspection conclusion.
Publicly post the inspection conclusion at the headquarters of Can Tho City Social Insurance for at least 15 consecutive days as prescribed.
The Chief Inspector of the Ministry of Labor, Invalids and Social Affairs requests the Director of Can Tho City Social Insurance to report (in writing) the results of implementing the above recommendations (with supporting documents) to the Inspector of the Ministry of Labor, Invalids and Social Affairs before November 30, 2024.
