Sending a question through the Government Electronic Information Portal, reader D.V.L asked: "I was born on October 10, 1967, a civil servant in the health sector, and have paid compulsory social insurance for 34 years and 11 months.
On January 1, 2025, I had a decision to retire early according to Decree No. 29/2023/ND-CP and it was not until June 26 that I received the support fund.
I know that Decree No. 178/2024/ND-CP of the Government takes effect on the same day I have a retirement decision (January 1, 2025) and there are cases where there is a retirement decision from January 1, 2025 according to Decree No. 29/2023/ND-CP but have not yet enjoyed the policy, but will still be applied according to Decree No. 178/2024/ND-CP.
I would like to ask, in my case, is Yen Bai province (old), now Lao Cai province, applying the regime for me according to Decree No. 29/2023/ND-CP correct? ".
Regarding this issue, the Ministry of Home Affairs responds as follows:
The cases of cadres, civil servants, public employees and commune-level cadres and public employees due to the arrangement of district and commune-level administrative units in the period of 2019 - 2021 and the period of 2023 - 2025 according to the Resolution of the National Assembly Standing Committee, who retire after January 1, 2025, are subject to the provisions of Point b, Clause 1, Article 2 of Decree No. 178/2024/ND-CP (amended and supplemented in Decree No. 67/2025/ND-CP).
The above subjects, if they quit their jobs before January 1, 2025 or on January 1, 2025, will not be subject to the provisions of Decree No. 178/2024/ND-CP (amended and supplemented in Decree No. 67/2025/ND-CP).
At the same time, in Decree No. 29/2023/ND-CP, Decree No. 178/2024/ND-CP (amended and supplemented in Decree No. 67/2025/ND-CP), the Government has assigned the heads of agencies, organizations, units and the People's Committee, the Chairman of the Provincial People's Committee to determine the subjects and decide on approval.
Therefore, Mr. D.V.L is requested to provide full information of the individual who needs to be questioned, send it to the local authorities and competent people for answers according to regulations.
