On the Government Portal, a citizen wondered:
Ms. T.T. N's father is a war invalid. Ms. N is also enjoying benefits for people affected by chemical toxins, who have lost their ability to work and are still self-reliant in daily life, with a decision to receive allowances from the District People's Committee in 2003.
Recently, when Ms. N submitted a dossier to buy social housing accompanied by a decision to enjoy benefits due to the impact of chemical toxins, the investor said that she had to go to the Commune People's Committee to apply for a disability certificate to be included in the priority area.
Ms. N went to the Commune People's Committee to apply, and was told that it could not be issued because her decision was issued by the District People's Committee and she is currently enjoying the Agent Orange regime, which is a higher preferential level than people with disabilities. Ms. N asked, is the investor's request for her to go to the Commune People's Committee to apply for a confirmation certificate correct? Why is her decision to receive allowances equivalent to the disability certificate not accepted?
The Ministry of Construction answers this question as follows:
Clause 1, Article 3 of Ordinance No. 02/2020/UBTVQH14 dated December 9, 2020 of the National Assembly Standing Committee on Preferential treatment for people with meritorious services to the revolution stipulates:
1. People with meritorious services to the revolution include:
a) Revolutionary activists before January 1, 1945;
b) Revolutionary activists from January 1, 1945 to the August Uprising of 1945;
c) Martyrs;
d) Vietnamese Heroic Mothers;
d) Heroes of the People's Armed Forces;
e) Labor Hero in the resistance period;
g) Injured soldiers, including type B injured soldiers recognized before December 31, 1993; people enjoying policies like injured soldiers;
h) Injured soldiers;
i) People who participated in the resistance war and were infected with chemical toxins;
k) People who participated in revolutionary activities, resistance war, national defense, and performed international duties and were arrested and imprisoned by the enemy;
1) People who participated in the resistance war to liberate the nation, protect the Fatherland, and perform international duties;
m) People who have contributed to helping the revolution".
Clause 2, Article 3 of Ordinance No. 02/2020/UBTVQH14 stipulates:
Relatives of people with meritorious services to the revolution include biological father, biological mother, wife or husband, children (biological children, adopted children), people with meritorious services raising martyrs".
Housing law stipulates 10 groups of subjects entitled to social housing support policies, including the group of subjects "People with meritorious services to the revolution, relatives of martyrs who are eligible for housing improvement support according to the provisions of the Ordinance on Preferential Treatment of People with Meritorious Services to the Revolution" (Clause 1, Article 76 of the 2023 Housing Law) and this group of subjects is entitled to priority order when buying, renting, or renting-purchasing social housing (point d, Clause 1, Article 79 of the 2023 Housing Law).
Based on the above regulations and information provided by Ms. N, Ms. N is a relative of people with meritorious services to the revolution, not belonging to the group of subjects specified in Clause 1, Article 76 of the 2023 Housing Law.
To be able to buy, lease, buy, or rent social housing, citizens must meet the correct subjects and conditions (housing and income) specified in Article 76, Article 78 of the 2023 Housing Law and Article 29, Article 30 of Decree No. 100/2024/ND-CP dated July 26, 2024 of the Government detailing a number of articles of the Housing Law on the development and management of social housing (amended and supplemented in Decree No. 261/2025/ND-CP dated October 10, 2025 of the Government and Decree No. 54/2026/ND-CP dated February 9, 2026 of the Government)...
