Citizen N.N reflected: "I am temporarily residing, living and working in Dong Van Industrial Park, Ha Nam (now Ninh Binh); married and have a total income of no more than 40 million VND/month; do not own any real estate in the area according to regulations.
I wish to register to buy social housing in the industrial park to stabilize my life and work with peace of mind.
After going to the sales consulting office of the investor HUD (Housing and Urban Development Investment Corporation - Company Limited) located in Dong Van, they received advice that "My wife and I are not eligible to register because my husband has a labor contract and works in Phu Tho, not in Ninh Binh province".
I have investigated under the guidance of the Ninh Binh Provincial Department of Construction (Officult Dispatch 3331 dated September 25, 2025) not clearly stating that the petitioner's wife or husband must also work in the province where the project is located.
So if I am the one who submitted the application to buy social housing, is it correct that my husband is also required to work in the project area? Is this a regulation of each Department of Construction or a general regulation of the state? ".
Regarding this content, the Ministry of Construction responded as follows:
Clause 1, Article 78 of the 2023 Housing Law stipulates: The subjects specified in Clauses 1, 4, 5, 6, 7, 8, 9 and 10, Article 76 of this Law for the purchase or hire-purchase of social housing must meet the following conditions:
Housing conditions: Subjects specified in Clauses 1, 4, 5, 6, 7, 8, 9 and 10, Article 76 of this Law to be able to buy or rent social housing must not have a house of their own in the province or centrally run city where there is a social housing construction investment project, have not been able to buy or rent social housing, and have not enjoyed any form of housing support policies in the province or centrally run city where there is a social housing construction investment project or have a house of their own in the province or centrally run city where there is a social housing project but the average housing area per capita is lower than the minimum housing area; in case of being a subject specified in Points b, c, d, dd, e and g, Clause 1, Clause 45 of this Law, they must not be in public housing. The Government stipulates in detail this point.
Income conditions: Subjects specified in Clauses 5, 6, 7 and 8, Article 76 of this Law to be able to buy or rent social housing must meet the income conditions prescribed by the Government; Subjects specified in Clause 4, Article 76 of this Law must be poor or near-poor households according to Government regulations".
Thus, based on the above regulations, to be able to buy or rent social housing, beneficiaries of social housing support policies must meet housing and income requirements, and are not eligible to work in the province or city where there is a social housing project.
