Citizen D.V.T reflected that, Clause 12, Article 78 of Decree No. 100/2024/ND-CP dated July 26, 2024 of the Government, in the case of a social housing construction investment project that has leased 20% of the total social housing floor area as prescribed in Clause 2, Article 26 of Decree No. 100/2015/ND-CP, if the tenant wants to buy a house being rented for a term of 05 years, the investor is allowed to sell the house to the tenant if it ensures the subjects and conditions prescribed in this Decree.
So after 5 years, can the investor sell this social housing to the tenant?
Regarding this content, the Ministry of Construction has the following opinion:
The Ministry of Construction would like to take note of citizens' opinions to synthesize and study to perfect regulations when amending and supplementing a number of articles of Decrees in the field of housing and real estate business (including Decree No. 100/2024/ND-CP dated July 26, 2024 of the Government detailing a number of articles of the housing law on the development and management of social housing) in the coming time.
The Ministry of Construction welcomes and hopes to continue to receive citizens' contributions to the real estate and social housing sector in the coming time.
