Mr. Dao Van Binh was discharged from the army in 1993. From December 1995 to present, he has been a state civil servant.

Regarding salary increase, on June 29, 2021, the Minister of Home Affairs issued Circular No. 03/2021 amending and supplementing Circular No. 08 2013 31.7. 2013 on guiding the implementation of the regular salary increase regime, early salary increase regime and seniority allowance regime beyond the framework for cadres, civil servants, public employees and workers effective from August 15, 2021.
Accordingly, the time he participated in military service under the Law on Military Service before the effective date of the Circular will not be counted as the time to consider regular salary increase.
The organization and implementation of policies for cadres, civil servants and public employees is under the authority of the Provincial People's Committee.
Therefore, the Ministry of Home Affairs has asked him to contact the provincial agency managing cadres, civil servants and public employees (Department of Home Affairs) for answers.
Regarding the addition of military service time to receive social insurance Pursuant to the provisions of Clause 2, Article 34 of Decree No. 158/2025 dated June 25, 2025 of the Government detailing and guiding the implementation of a number of articles of the Law on Social Insurance on compulsory social insurance.
Accordingly, employees who have worked as soldiers, people's police who were demobilized, discharged, or quit their jobs before December 15, 1993, and then worked and participated in compulsory social insurance at agencies, units, and enterprises in economic sectors (including those working in the health sector of communes, wards, and towns, preschool teachers or holding positions in communes, wards, and towns, preschool teachers or those holding positions in communes, wards, and towns before January 1, 1995, which have been counted as the time of social insurance payment) and individuals who have hired or used labor but do not enjoy the allowance regime prescribed in this clause, will have their previous working time in the army and police added to the time of social insurance payment later to enjoy social insurance.
